These Terms and Conditions govern your use of numerocinqueno5pty.site and any services provided by Numero Cinque No.5 Pty Ltd (ABN 78 697 023 395 / ACN 697 023 395). By accessing our Site or engaging our services, you agree to be bound by these Terms.
These Terms are governed by the laws of Western Australia and the Commonwealth of Australia, including the Competition and Consumer Act 2010 (Cth) (incorporating the Australian Consumer Law), the Food Act 2008 (WA), and the Liquor Control Act 1988 (WA).
Numero Cinque No.5 provides Italian-themed restaurant dining, espresso cafe, wine bar, private events, artisan bakery, and catering services in Perth CBD, Western Australia. Specific terms for events and catering will be set out in a written agreement.
Reservations are subject to availability. We request at least 24 hours' notice for cancellations. For private events and catering, cancellation terms will be specified in the event agreement. No-shows may be subject to a cancellation fee as communicated at the time of booking.
All prices are in Australian Dollars (AUD) and inclusive of GST where applicable. GST is applied in accordance with the A New Tax System (Goods and Services Tax) Act 1999 (Cth). Payment for dining services is due at the time of service. Catering and events may require deposits as specified in the event agreement.
We are committed to the responsible service of alcohol in accordance with the Liquor Control Act 1988 (WA). We reserve the right to refuse service to any patron in accordance with WA liquor licensing laws.
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term implied or imposed by the Australian Consumer Law (ACL) that cannot be lawfully excluded or limited. Where our services are provided to a consumer under the ACL, you may have consumer guarantees including that services will be rendered with due care and skill.
Subject to the ACL and to the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential loss or damage arising from your use of the Site or our services.
All content on our website is owned by or licensed to Numero Cinque No.5 Pty Ltd. You may not reproduce or commercially exploit any content without our permission.
Your personal information is handled in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).
Disputes will first be addressed through good-faith negotiation. If unresolved, disputes may be submitted to mediation and ultimately to the courts of Western Australia.
